  1. DATA CONTROLLER

SCHLAICH DAUSS VERDIA, S.L.P. (hereinafter, “SD VERDIA”), with registered office at Passeig de Gràcia, 54, 3rd floor, C, 08007 Barcelona, is the company responsible for the processing of the data collected or generated when accessing, using and browsing our website, as well as the data provided through the contact methods available on this website.


  1. PURPOSE OF DATA PROCESSING AND CATEGORIES OF DATA PROCESSED SD VERDIA shall process the data provided manually and/or by automated means, and such data shall not be subject to automated decision-making. The purposes shall be the following:
    • To provide the legal services entrusted (such services may be provided directly by SD VERDIA or subcontracted);
    • To send commercial information to clients, tailoring such information to their profiles;
    • To manage profiles of potential recruits/hires;
    • To manage commercial relationships with suppliers; and
    • To comply with legally established obligations or respond to requests from competent authorities.

Taking into account the established purposes, SD VERDIA shall process (i) personal data (full name, postal address, email address, telephone number, etc.); (ii) financial data (bank accounts, tax returns, etc.); (iii) data necessary for the provision of legal advice; and (iv) academic and professional data (education, qualifications, professional experience and other data relevant to the selection of professionals).

The data provided by the user must be accurate, and the user shall be responsible for any damage or loss caused by the inaccuracy of the data provided. Likewise, in the event that the user provides SD VERDIA with information relating to third parties, the user must declare that they have obtained the consent of such third parties for the transfer of the data to SD VERDIA and that they have informed such third parties of this Privacy Policy, thereby releasing SD VERDIA from any liability in this regard. In the event that the user does not provide all the data necessary for the proper provision of the services, SD VERDIA does not guarantee an adequate and satisfactory provision of its services to the user.


  1. DATA RETENTION PERIODS

SD VERDIA shall only retain user information for the time necessary to provide the services entrusted to SD VERDIA, provided that the consents granted have not been revoked. Thereafter, and only where necessary, SD VERDIA shall retain the data for the legally established periods.

In the event that the user has provided their data in relation to a job offer or to submit their application, such data shall be retained for at least one year from the date of the last update.

Once the data retention periods have elapsed, the data shall be securely deleted.


  1. SECURITY MEASURES IMPLEMENTED

SD VERDIA has implemented sufficient security measures to adequately protect users’ information. Such security measures include technical security measures such as, for example, the encryption of communications between users and SD VERDIA’s servers, as well as the encryption of information on SD VERDIA’s servers.

As a general rule, SD VERDIA will not transfer data to third parties located outside the European Economic Area. However, in exceptional cases this may occur, particularly for users who maintain personal and/or commercial relationships with Switzerland. In such cases, SD VERDIA shall ensure that appropriate security measures are in place and guarantees that the information is shared with adequate safeguards and only with countries that offer a level of data protection similar to that provided by the European Union.


  1. DATA DISCLOSURE

Within the framework of the contractual relationship maintained by the user with SD VERDIA and in compliance with current regulations, SD VERDIA may be required to disclose personal data to public authorities (including courts), banks and financial institutions; other professionals for the proper provision of the entrusted services or where such disclosure is required by law; and law enforcement authorities.


  1. LEGAL BASIS

The legal basis for data processing is the user’s consent and the provision and performance of the contracted services. Likewise, data may also be processed as a result of SD VERDIA’s legal obligations.


  1. USERS’ RIGHTS

The user has the right to exercise at any time and in accordance with applicable legislation their rights of access, rectification or erasure of data, to request the restriction of processing, to object to processing, to request data portability and to withdraw the consent given. For this purpose, the user must submit a written request to Passeig de Gràcia, 54, 1st floor, 08007 Barcelona, or by email to: info@sdverdia.com. In order to provide a swift and effective response, the user must clearly indicate the right or rights they wish to exercise and state their full name and identification document. Likewise, the user is entitled to lodge a complaint with the Spanish Data Protection Agency (www.agpd.es – C/ Jorge Juan, 6, Madrid), although SD VERDIA encourages the user to contact the firm first.
